MOTHER'S DAY 2025 ART COMPETITION
TERMS & CONDITIONS OF ENTRY
1. The Promoter of this competition is Jurlique International Pty Ltd, located at Level 7, 227 Elizabeth Street, Sydney NSW (Promoter).
2. This competition commences on 9am 17th June and concludes on 5pm 1st July 2024 (Promotional Period). All times are AEST.
3. By submitting an entry to this competition, you accept these terms and conditions including instructions and information on how to enter this competition which form part of the terms and conditions (Terms).
4. To be eligible to enter this competition, entrants must:
a. Be at least 16 years of age at the time your entry is submitted;
b. not be an immediate family member of any person involved in judging the competition; and
c. Not be a Jurlique employee or contractor. (Eligible Participants).
HOW TO ENTER
5. To enter, Eligible Participants must, during the Promotional Period:
a. Complete all required information in the entry form at https://jurlique.co.uk/pages/ others-day-art-competition
b. Submit a photo of one artwork (Artwork) meeting the Artwork Criteria set out in clause 5
c to https://jurlique.co.uk/pages/mothers-day-art-competition. A separate entry form must be submitted for each Artwork entered.
c. To be eligible for entry, Artworks must:
• be created solely by the Eligible Participant entrant, and no part of the artwork can be borrowed or copied;
• be an original drawing, painting, photography, mixed media work, made from any traditional media including pastel, oils pastel, pen, pencil, acrylics, watercolour, oils, mixed media, collage, or other materials or a digitally created artwork. Videos and sculptures will not be accepted;
• depict 1 or more of the botanicals which are grown on the Jurlique farm, or which are depicted in the Information booklet;
• include bright, bold colours (no black);
• be at least A4-A3 paper sized;
• not contain logos, or reference to any brand, licensed character or image (e.g. a character from a movie, book, cartoon, comic, TV show);
• not contain any selfies, or photographs of recognisable people or products; and
• not contain any offensive material, (the Artwork Criteria).
6. Only entries submitted by Eligible Participants during the Promotional Period which meet the Artwork Criteria in accordance with these Terms will be valid (a Valid Entry).
7. Entries which do not meet the criteria for a Valid Entry will be disqualified and will not be published for voting or be eligible to win.
8. Each Eligible Participant can submit multiple entries.
9. Entrants are encouraged but not required to take photographs and videos of themselves creating their artworks, photographs and videos must not be submitted with the entry, however, may be requested from the winners.
10. Entrants are responsible for all expenses that they incur in participating in the competition.
11. This competition is a “game of skill”, all Valid Entries will be reviewed, judged and one or more winners will be selected by the Promotor by 5pm 2nd July 2024.
12. The judging criteria include:
a. Concept – how well the artwork relates to the Jurlique botanicals theme;
b. Composition and colour how well the elements of the artwork convey the Jurlique botanicals theme;
c. Expression – how imaginatively the artwork conveys its idea or emotion.
13. The judge’s decision is final.
14. The Promotor may, in its’ absolute discretion, select one or more than one winner.
15. Winner(s) and Jurlique Nominee(s) will be notified by email using the email addresses provided on the entry form.
16. In order to redeem the prize, within 14 days of receiving the notification email:
a. The winning entrant must reply to the email confirming their phone number and delivery address; and
b. Jurlique must receive the original of the artwork selected as a winning entry, packaged to ensure that it does not get damaged in transit, to Jurlique Global Promotions team at Jurlique, Level 7, 227 Elizabeth Street Sydney NSW 2000. (the Redemption Criteria).
17. Your entries and original Artwork will not be returned to you.
18. If the Redemption Criteria are not met, the winner’s entry will be deemed invalid, and the Promoter reserves the right to conduct further judging on 16th July 2024 at the same location as the original judging and at its absolute discretion select another winner.
19. No responsibility is accepted for entries not received by the Promotor and/or incorrectly completed by the closing date and time. Promotor’s decision as to when an entry is received or whether the entry is incorrectly completed is final.
PRIZE
20. Each winning entry which satisfies the Redemption Criteria will receive a pre-paid credit card to a value of AUD 5000.00.
21. The prize(s) are not transferable and cannot be redeemed for cash.
22. The Promoters, in their discretion, reserve the right to substitute the prize with a prize to the equal value and/or specification.
23. The Promotor will not be responsible for any prize not received due to any error or omission in the address nominated by the winner, or for any late, lost, stolen or misdirected deliveries or mail.
USE OF ENTRANTS NAME, INFORMATION AND ARTWORK
24. You confirm that the Artwork entered by you is original and does not infringe the intellectual property rights of any third party.
25. Proof of ownership may be required, and you agree to complete or provide all such documentation as may reasonably be requested to confirm such proof of ownership.
26. By entering this competition, you grant to the Promotor an exclusive, unrestricted, irrevocable, transferable, right and licence to use and modify the Artwork entered by you in perpetuity, including, without limitation, for promotional purposes without the payment of any further fee or compensation or further reference to the entrant whether or not the Artwork is selected as a winning entry. To the extent permitted by law, you unconditionally and irrevocably consent to the Promotor modifying the Artwork as described in this clause.
27. This license to use the Artwork for these commercial purposes is not a transfer of copyright which remains with the artist.
28. By entering you agree that the Promotor may publish your name, age,, written work, artwork, and photographic and video images of the entrant including without limitation, online, at any events held by the Promotor and on product packaging and marketing collateral.
29. Jurlique may at its absolute discretion and without further notice use the Artwork or any part of it, and/or photographic and/or video images of you in its promotional and marketing campaigns, on packaging and in any other way in connection with the marketing and sale of Jurlique branded products, including without limitation, in on marketing materials and communications in store, website banners, print, digital and social media . However, Jurlique is not obliged to use any Artworks or images in this or any other way including, without limitation, any winning entry Artworks.
ACTIVATION CONTENT
30. You understand and agree that it is a condition of entry and of winning that you agree to provide Jurlique with additional activation content including but not limited to participating in written interviews, additional photos and video footage within 12 months of receiving notification of the winning entry (Activation Content).
PERSONAL INFORMATION
31. You acknowledge that your personal information is collected to enable Promotor to administer and promote this competition.
32. You understand and agree that the Promotor will collect personal information from you when you enter the competition and use it for the purpose of running the competition (which may include disclosure to our third party service providers for the purpose of processing and conducting the competition) and for promotional purposes surrounding the competition.
33. All personal information collected will be dealt with in accordance with Australian privacy laws and the Promoter’s Privacy Policy, which can be viewed at https://jurlique.co.uk/pages/privacy-policy
34. You consent to the collection, use and disclosure of the relevant entrant’s personal information by the Promotor.
35. Entrants who fail to provide all requested personal information may be determined by the Promotor, at its sole discretion, to be ineligible to win a prize.
OTHER
36. To the extent permitted by law, the Promoter (including its officers, employees and agents) and its associated agencies and companies will not be liable for any loss (including, without limitation, direct, indirect, special or consequential loss, or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) relating to or in connection with this competition or accepting or using any prize.
37. You indemnify the Promotor on demand by the Promotor in respect of all claims demands, liability, damages or causes of action (however named or described) losses, costs or expenses directly or indirectly incurred or suffered by the Promotor in respect of the following:
a. any infringement by you of any intellectual property rights of any other person in respect of your entry;
b. making your entry;
c. any injury or damage to you or any other person's computer relating to or resulting from participation in or downloading any materials in connection with making your entry;
d. the use of your entries by the Promotor; and
e. any breach of these Terms and Conditions.
38. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant where the Promoter believes that the entry or the entry process has been tampered with or where any entry has been submitted not in accordance with the Terms and Conditions.
39. The Promoter reserves the right, at its sole discretion and without notice, to cancel, modify or suspend these terms and/or this competition in whole or in part, including, but not limited to in the event of fraud, technical or other difficulties or if the integrity of the competition is compromised, without liability to the participant.
40. No correspondence will be entered into.
